PLUGIN OPTICS BUY AMERICA COMPLIANT EQUIPMENT
On February 23, 2024, the U.S. Department of Commerce issued a limited, general nonavailability waiver for the Build America Buy America (BABA) preference requirements under the Broadband Equity Access and Deployment (BEAD) Program. This waiver applies to certain construction materials and manufactured products. To ensure compliance, NTIA has implemented a self-certification and compliance framework for manufacturers.
As part of this process, the Department of Commerce is maintaining a list of manufacturers whose officers have certified specific products they produce. Under the Program Fraud Civil Remedies Act (31 U.S.C. § 3801 et seq.), the False Claims Amendments Act of 1986, and the False Statements Accountability Act of 1996 (18 U.S.C. §§ 287 and 1001), Plugin Optics certifies that it fully complies with the BABA waiver for the BEAD Program.
